Why auction conveyancing needs early legal input
Auction property can offer opportunity, but the timetable is very different from a normal estate-agent sale. A successful bid will usually create a binding contract immediately, meaning the buyer cannot rely on carrying out the main legal investigation afterwards. The legal pack may include title documents, searches, leases, tenancy information, special conditions and other papers that affect what you are buying and how quickly you must complete. RG Law can review the pack before the auction and explain issues that may affect your decision, funding or future use of the property. If you proceed, the team can then work to the auction completion timetable.
What a pre-auction review can cover
• Registered title and title plan • Contract and special conditions • Searches included in the legal pack • Lease and management information where applicable • Tenancy or occupational documentation • Restrictions, covenants and rights • Completion deadline and contractual penalties • Buyer’s premium or additional sums stated in the contract • Obvious issues that may affect mortgageability or use
Thinking about bidding?
Do not wait until auction morning to look at the legal pack. Give your conveyancer enough time to review the documents and raise the issues that matter to you before you commit.

Buying at auction — the legal sequence
1. Identify the lot and obtain the auction legal pack. 2. Instruct RG Law to review the legal documentation before bidding. 3. Arrange funding and any survey or valuation you require. 4. Decide your bidding limit in light of the legal and financial position. 5. If your bid succeeds, the auction contract becomes binding under the auction conditions. 6. Pay the required deposit and auction charges. 7. RG Law completes any remaining legal steps and prepares for completion. 8. Complete within the contractual deadline. Because the completion period can be short, buyers using mortgage finance need to ensure the funding timetable is realistic before bidding.
Auction conveyancing fees and additional costs
RG Law currently advertises auction conveyancing from £750. The final legal fee will depend on whether the work is a pre-auction review, purchase, sale, legal-pack preparation or a more complex transaction. Auction buyers should also read the special conditions carefully because they can require the buyer to pay additional amounts that would not normally arise in a standard purchase. These can sit alongside Stamp Duty, Land Registry fees, searches, lender fees and other transaction costs.
Auction completion deadlines
The completion date is set by the auction contract or special conditions and can be much quicker than a normal private-treaty transaction. Missing that deadline can have serious financial and legal consequences. This is why the real work starts before you bid: legal review, finance planning and understanding the conditions. After a successful bid, the focus changes from investigation to delivery against a contract you are already bound by.
Common auction risks to look for
Auction lots may be straightforward, but buyers should be alert to short leases, title defects, restrictive covenants, planning issues, occupied property, missing rights, unusual service-charge provisions, development restrictions, seller-imposed additional costs or very short completion deadlines. A low guide price is not a substitute for legal due diligence. The purpose of a pre-auction review is not to tell you whether to bid, but to help you understand the legal position before you decide.
Auction conveyancing FAQs
Q: Am I legally bound when the hammer falls? A: Usually yes, subject to the auction conditions. You should assume a successful bid creates an immediate legal commitment. Q: Can I get a mortgage on an auction property? A: Possibly, but the property must meet the lender’s requirements and the lender must be able to complete within the auction timetable. Q: Should I have the legal pack reviewed before bidding? A: Yes, particularly if you are not comfortable interpreting title documents and special conditions yourself. Q: What if the legal pack is incomplete? A: That is itself important information. Ask your conveyancer what is missing and what risk that creates before deciding whether to bid. Q: Can RG Law act on commercial auction property as well? A: Yes, RG Law’s auction service covers residential and commercial property transactions.
